General Terms and Conditions of Sofio's Candle
- § 1 Scope
- (1) These General Terms and Conditions apply to all contracts between Sofio Sachse, Rheinstraße 32, 64283 Darmstadt (hereinafter referred to as "Seller") and consumers (§ 13 BGB) regarding orders in the online shop. https://www.sofios-candle.com/.
- (2) Deviating conditions of the customer shall not become part of the contract unless the seller expressly agrees to their validity in writing.

- § 3 Conclusion of contract
- (1) The presentation of products in the online shop is non-binding.
- (2) By clicking the button "order for a fee," you submit a binding offer to conclude a purchase contract. (3) The contract is concluded as soon as we accept your order by sending an order confirmation via email.
- § 4 Right of Withdrawal
- You have the right to withdraw from this contract within fourteen days without giving any reason.
- The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.
- To exercise your right of withdrawal, you must inform us (Andreas-Maximilian Sachse, Rheinstraße 32, 64283 Darmstadt, E-Mail: sofiosachse@gmail.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached sample withdrawal form for this purpose, but it is not mandatory.
- To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
- Consequences of Withdrawal
- If you withdraw from this contract, we will refund you all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a different type of delivery than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we receive the notification of your withdrawal from this contract. For this refund, we will use the same payment method you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged any fees for this refund.
- We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
- You must return the goods without delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract to

- The deadline is met if you send the goods before the fourteen-day period has expired.
- You bear the direct costs of returning the goods.
- You only have to pay for any loss in value of the goods if this loss in value is due to handling them in a way that is not necessary for checking their nature, characteristics, and functioning.

- Note: The right of withdrawal is excluded for personalized candles (e.g., with engraving) after production has started (§ 312g Abs. 2 BGB).
- § 5 Prices and Shipping Costs
- (1) All prices stated are final prices.
- (2) Shipping costs are listed separately. Currently, a flat rate of [e.g., €4.99] applies within Germany.
- (3) Delivery is made exclusively within Germany via DHL.
- § 6 Delivery and Transfer of Risk
- (1) The delivery time is usually 3–7 working days after receipt of payment.
- (2) The risk of accidental loss and accidental deterioration of the goods passes to the customer upon delivery.
- § 7 Payment
- Payment methods: Stripe (credit card, SEPA direct debit, etc.). In the case of prepayment, delivery takes place after receipt of payment.
- § 8 Retention of title
- The delivered goods remain the property of the seller until full payment is made.
- § 9 Warranty
- The statutory warranty rights apply (§§ 434 ff. BGB). For handmade unique candles, slight deviations in color, shape, or scent may occur. These do not constitute a defect.
- § 10 Liability
- (1) We are fully liable for intent, gross negligence, and for injury to life, body, or health.
- (2) In the event of a breach of essential contractual obligations, we are also liable for simple negligence, but limited to the typical, foreseeable damage.
- (3) Otherwise, liability is excluded.
- (4) We are not liable for damages resulting from improper use of the candles (especially fire risks). Safety and warning instructions must be strictly observed.
- § 11 Data protection
- The protection of your personal data is our highest priority. Please refer to our separateprivacy policy.
- § 12 Dispute Resolution / Jurisdiction / Applicable Law
- (1) We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
- (2) For all legal relationships between us and the customer, only the law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG).
- (3) If the customer is a businessman, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes isDarmstadt. For consumers, the statutory places of jurisdiction apply.
- § 13 Severability Clause
- If any provision of these terms and conditions is invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
- In place of the invalid provision, an effective regulation shall apply that comes closest to the economic purpose of the invalid provision.
